1. Who we are

PRESS-KIT.CLOUD (the "Service") is operated by Andrea Chirivi("we", "us", "our"). By creating an account or using the Service you ("you", the "user") agree to these Terms & Conditions. If you do not agree, do not use the Service.

2. The Service

PRESS-KIT.CLOUD provides software for DJs, electronic music producers and other artists to build, publish and export electronic press kits (EPKs) as shareable web pages and PDFs. We may update, change or discontinue features at any time.

3. Your account

You must be of legal age in your jurisdiction (or have authority to bind your organisation). You are responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.

4. Acceptable use

You must not misuse the Service. In particular you must not:

• use the Service for unlawful, fraudulent or abusive purposes (including spam);
• upload content that infringes intellectual property, privacy or other rights;
• interfere with the security or integrity of the Service (malware, probing, scraping, reverse engineering, circumventing technical limits);
• resell or redistribute the Service without our written consent.

5. Your content

You retain ownership of the artist information, bios, photos and other content you upload ("User Content"). You grant us a limited, worldwide, non-exclusive licence to host, process and display your User Content solely for the purpose of providing the Service to you and the recipients of your published EPK.

6. Our intellectual property

We retain all rights, title and interest in the Service, including its software, templates, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your selected plan.

7. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Checkout Buyer Terms in addition to these Terms and our Refund Policy.

Paid plans renew automatically at the end of each billing period until cancelled. You can cancel at any time via the customer portal; you keep access until the end of the current period.

8. Suspension and termination

We may suspend or terminate your access if you materially breach these Terms, fail to pay, create a security or fraud risk, or repeatedly violate our acceptable-use rules. On termination your right to use the Service ends. We will make reasonable efforts to let you export your data for a limited period before deleting it.

9. Disclaimer of warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties (including merchantability and fitness for a particular purpose) and do not guarantee that the Service will be uninterrupted, error free or meet your specific requirements.

10. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is capped at the fees you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special or incidental damages, including loss of profits, data or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law (such as fraud, death or personal injury caused by negligence).

11. Indemnity

You will indemnify us against third-party claims arising from your User Content, your unlawful use of the Service or your breach of these Terms.

12. Governing law

These Terms are governed by the laws of Italy, the jurisdiction of the seller, without regard to its conflict-of-law provisions. The competent courts of that jurisdiction have exclusive jurisdiction, subject to any mandatory consumer-protection rights you have in your country of residence.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-product notice. Continued use of the Service after changes take effect constitutes acceptance.
